Cancellation Policy

Any cancellation request more than 100 days before the start of a workshop will receive a full refund minus your deposit, which can be applied toward a future tour. If you decide not to attend a future workshop, this deposit is forfeited. 

If you cancel within 100 days, no refunds of any kind will be issued.

If you cancel your reservation within 100 days and we are able to fill your space on a tour, we will provide a full refund.

Once a tour has started, no refunds will be given for missed outings, delays, weather related events, or elements beyond our control. In the event of an emergency, I’m more than happy to work with you. I highly recommend purchasing travel insurance, which covers non-refundable fees and travel expenses.

Workshop Cancellation

In the unlikely event a workshop is canceled by Warner Wilderness Photography LLC, you will receive a full refund for what you paid. We reserve the right to cancel a workshop due to weather, safety, or elements beyond our control. The liability of Warner Wilderness Photography LLC is limited to the cost of the workshop or expedition and does not include any additional travel costs such as airfare, transportation, accommodation, or other expenses. If a workshop is canceled, I will contact all participants as soon as possible. 

Workshop Outings / Schedule Changes

Warner Wilderness Photography LLC makes no guarantees on exact itineraries, and any itinerary listed is merely an example of what we could potentially do. We reserve the right to modify an itinerary to account for weather, closures, safety, acts of God, and situations beyond our control. 

Tuition / Workshop Fees

All workshop fees must be paid in full at least 30 days before the start of the workshop. Unpaid fees within 30 days of the start of a workshop will result in that participant’s cancellation and the forfeiture of their deposit.

Health / Fitness 

Workshop participants must be in adequate health, both physical and mental, in order to attend. I do my best to accurately list what level of physical activity is required for specific workshops. There will be no refunds or discounts for missed outings due to one’s physical abilities or lack thereof. We reserve the right to remove you from a workshop if your physical abilities would negatively impact the rest of the group’s safety or activities. Any expenses incurred by you leaving a workshop are yours and yours alone. We reserve the right to deny your enrollment in a current or future workshop if we have determined you are not physically fit enough for the activities. By signing up for a workshop, you authorize Warner Wilderness Photography LLC guides and trip leaders to provide and initiate medical care in the event of an emergency. Assumption of Risk & Liability

By attending one of our workshops, you accept the inherent risks of travel that include but are not limited to: injury, illness, death, personal property damage and loss, all of which may be caused by accident, nature, personal negligence, or other reasons.

By paying for and attending a Warner Wilderness Photography LLC workshop, tour, or expedition, you are releasing Warner Wilderness Photography LLC’s employees, contractors, or partners from the liability of any injuries, accidents, or costs incurred from medical attention. You acknowledge that by traveling to and recreating in nature, wilderness areas, and foreign countries that Warner Wilderness Photography LLC conducts tours in, there are inherent risks and dangers that include but are not limited to: falls, personal injury, recreational equipment failure, vehicle / aircraft accidents, animal attacks, terrorism, and natural disasters. You acknowledge that medical care or facilities may not be available during a tour. Warner Wilderness Photography LLC assumes no liability for medical care, medication, or dietary requirements. By attending a Warner Wilderness Photography LLC workshop, tour, or expedition, you are agreeing to follow the rules, advice, and direction regarding wildlife safety, outdoor safety, vehicular safety, personal safety, and respect for the outdoors.

Release of Liability Waiver

Participation in a Warner Wilderness Photography LLC tour requires filling out our liability release prior to the start of a tour. Refusing to do so will result in forfeiture of your spot on the tour and any and all payment.

Name and Likeness Release

Warner Wilderness Photography LLC reserves the right to take your photo or video during the course of a workshop, tour, or expedition for use in promotional materials. If you don’t agree to this, please let us know before the start of any tour.

Third Party Services

We occasionally rely on third party services including but not limited to: transportation providers, food vendors, and tour operators. We cannot control the actions of these providers and assume no responsibility for any unanticipated delays, cancellations, overbookings, lost luggage, or reservation errors. We urge every participant to have flexible travel plans in the case of unexpected travel delays. No refunds will be given for any unanticipated events resulting in a schedule change. You agree that we are not liable for injury, death, property damage, or delay that may occur with any service provided by a third party.

Arbitration

You agree to have any claim, controversy, or dispute relating to the enforcement or interpretation of this document or arising or relating to your registration, participation, or attendance at a Warner Wilderness Photography LLC tour, workshop, or expedition, submitted to binding arbitration under the rules and regulations of the American Arbitration Association. The arbitration shall take place in Salt Lake City, Utah. You do hereby waive your right to bring an action before a judge or jury in any court, and you understand that you have given up your rights to discovery and appeal. Any award rendered in any arbitration may be made a judgment by any court of competent jurisdiction. You understand that if you refuse to submit to arbitration after agreeing to this provision, you may be compelled to arbitrate under the authority of the Utah Rules of Civil Procedure.

Responsibility of Participation

By participating in a Warner Wilderness Photography LLC workshop, you are expected to be respectful of others and act in a cooperative manner. If you are acting inappropriately, we reserve the right to deny your participation or remove you from a tour, workshop, or expedition without refund.
